All payments are processed through 2Checkout. This means that you have to manually pay the bills on 2Checkout site (a link will be available for you in the billing system). We allow a 10 days delay of payment, after we suspend your account. If you did not pay the recurring billings within 30 days, your account will be terminated.
Emirys provides a 30 Day Money Back Guarantee on all our services except for domain registration and setup fees. Whenever you wish to cancel your account due to any reason within the first 30 days, a full refund will be credited to your account.
We reserve the right to change prices listed on Emirys, and the right to increase the amount of resources given to plans at any time.
Account setup - your account will be set up in 15 minutes max. We will ask you to send us a scan of your ID, Passport or Driver License, to make sure your order is not fraud.

All services provided by Emirys may only be used for lawful purposes.
We do not allow:
» Violating the laws, regulations, ordinances or other such requirements of any applicable Federal, State or local government.
» Threatening/Harming any kind of person or propriety
» Cracking/phreaking, exploiting
» Attempting any unauthorized access to any Emirys private accounts
» Inappropriate communication to any Newsgroup, Mailing List, Chat Facility, or other Internet Forum.
» Infringing any copyright, trademark, patent, trade secret, or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software.
» Giving away free space, e-mail boxes or any server resources
» Spam, IRC Bots, Warez Sites, Pirated Software, Hate Sites, Hack programs and archives, Bit Torrents and game servers.
» Resource Usage: we do not allow usage more then 25% system resources for more than 60 seconds.

We DO allow adult sites.

Unsolicited Email (Spam)

Unsolicited commercial advertisements (spam) are not allowed in e-mail, and will likely result in account cancellation. Such as: Unsolicited bulk or commercial messages ("spam"). This includes, but is not limited to, bulk mailing of commercial advertising, informational announcements, charity requests, petitions for signatures, and political or religious tracts. Such messages may only be sent to those who have explicitly requested it from your domain.
Forging, altering or removing electronic mail headers is prohibited. Any domain sending stealth spam will be terminated without warning and without refund.
Sending numerous copies of the same or substantially similar message with the intent to disrupt a server or account ("mail bombing").
Spamming Newsgroups: Commercial advertisements are unwelcome in most Usenet discussion groups and on most e-mail mailing lists.
Mail may not be used to harass or intimidate others. Harassment, whether through language, frequency of messages, or size of messages, is prohibited.

Backups and Data Loss

Your use of the service is at your own risk. Emirys is not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on Emirys servers. We do create daily backups and tape backups, but because there is a hacker risk (no system is 100% hackproof), we cannot guarantee no data loss.
Account Cancellation In order to cancel your account please send an email to billing[at]emirys.com with the below information. Sending an email and simply requesting to terminate an account will not be considered due to security and client safety purposes. Information to include in your cancellation request email: (REQUIRED) Domain Name

E-mail must be sent from the email address you have in file with us.
Note: Account cancellations must be done at least 5 days prior to the next billing cycle in order to prevent the following months charge.

Intellectual Property Rights

Material accessible to you through Emirys's services may be subject to protection under the United States or other copyright laws, or laws protecting trademarks, trade secrets or proprietary information. Except when expressly permitted by the owner of such rights, you must not use Emirys or its servers and network in a manner that would infringe, violate, dilute or misappropriate any such rights, with respect to any material, which you access or receive through the Emirys network. If you use a domain name in connection with Emirys or similar service, you must not use that domain name in violation of any trademark, service mark, or similar rights of any third party.
SiteBuilder, cPanel etc. - You may not sell or distribute in any circumstance this software. You are allowed using this software in personal interests only. You understand that all software included in your package (cPanel, SiteBuilder, PHPMyAdmin, etc.) is provided to you as FREE software.

Network Security

Customers may not use the Emirys network with an attempt to circumvent user authentication or security of any host, network, or account. This includes, but is not limited to, accessing data not intended for the customer, logging into a server or account the customer is not expressly authorized to access, password cracking, probing the security of other networks in search of weakness, or violation of any other organization's security policy. Customers may not attempt to interfere or deny service to any user, host, or network. This includes, but is not limited to, flooding, mail bombing, or other deliberate attempts to overload or crash a host or network. Emirys will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal violations. Users who violate system or network security may incur criminal or civil liability.

Affiliates And Resellers

Affiliates - Please note that every referred customer must stick with us at least 2 months. If one of the referred customers does not stick with us at least 2 months, you will not get paid. Please note that you will receive your funds only after the 2 months have passed, in max. 7 days. You may advertise in any methods you want, but not through spam or illegal methods. Resellers - You and all your clients must respect this agreement.

Account Termination

Any customer who does not respect this Agreement is subject to account termination without notice and refund. Changes to This Policy Emirys may change this agreement at any time without notice.
